Why It Matters
A patent gives an inventor the exclusive right to make, use, sell or licence an invention for 20 years, and stops competitors from copying it without permission. In a market where product ideas travel fast, filing early even a provisional application is what turns "our idea" into "our legal asset."
No one can manufacture, import, sell or replicate your invention without your consent enforceable in court against infringers.
Patents can be licensed for royalty income, assigned, or used to raise funding investors treat granted IP as tangible valuation.
"Patent Pending" and "Patented" status positions a startup as a genuine innovator, not just another me-too product.
New Rules & Regulations
The Indian Patent Office has been actively modernising filing procedures. Here's what every applicant filing in 2026 needs to know before submitting Form 1.
Applications filed on or after 15 March 2024 must file the Request for Examination within 31 months of the priority or filing date down from 48 months pushing applicants toward faster, earlier drafting decisions.
Instead of updating the Controller every six months, applicants now submit Form 3 once within six months of filing, and once again within three months of the First Examination Report.
Patentees no longer disclose exact revenue/sales figures a simple tick-box confirms whether the patent is commercially "worked," filed once every three financial years instead of annually.
Inventors can now be formally recognised on record, even where the applicant/owner is a company closing a long-standing gap in Indian patent certificates.
Under Rule 138, most deadlines can be extended up to six months on request (Form 4), removing the earlier risk of applications lapsing over a missed non-extendable date.
Natural person, startup, small entity and educational-institution applicants continue to pay a fraction of the large-entity official fee SSATAX checks your eligibility before filing.
Don't File the Wrong Form
One of the most common mistakes founders make is registering the wrong type of IP. Here's the difference, side by side.
| IP Type | What It Protects | Validity | Governing Law |
|---|---|---|---|
| Patent | New invention, product or technical process | 20 years | Patents Act, 1970 |
| Trademark | Brand name, logo, tagline, jingle | 10 years, renewable indefinitely | Trade Marks Act, 1999 |
| Copyright | Literary, artistic, musical & software works | Lifetime of author + 60 years | Copyright Act, 1957 |
| Design | Visual shape, pattern or ornamentation of a product | 10 years, extendable by 5 | Designs Act, 2000 |
| Geographical Indication | Products tied to a specific region (e.g. Darjeeling Tea) | 10 years, renewable | GI Act, 1999 |
Registration Process
A real, ordered procedure prescribed by the Indian Patent Office SSATAX manages every stage on your behalf.
We assess novelty against Indian and global databases (InPASS, Espacenet) to confirm your idea is genuinely patentable before you spend on drafting.
Our patent agents draft technical description, drawings and claims the single most important document that defines your legal protection.
Form 1 (application), Form 2 (specification), Form 3 & Form 5 are filed electronically with the appropriate patent office (Delhi, Mumbai, Chennai or Kolkata).
The application is published in the Official Patent Journal, or earlier on request for expedited publication.
We file Form 18/18A and respond to objections raised in the First Examination Report (FER) within the prescribed window.
Once objections are resolved and the Controller is satisfied, the patent is granted and published protection is backdated to the filing date.
Annual renewal fees keep the patent alive for up to 20 years; SSATAX tracks due dates and files Form 27 for you every 3 years.
