What changed under the Patents (Amendment) Rules, 2024–2026

The Indian Patent Office has been actively modernising filing procedures. Here's what every applicant filing in 2026 needs to know before submitting Form 1.

Old: 48 months

Request for Examination (RFE) window cut to 31 months

Applications filed on or after 15 March 2024 must file the Request for Examination within 31 months of the priority or filing date down from 48 months pushing applicants toward faster, earlier drafting decisions.

Simplified

Form 3 (foreign filing details) now filed only twice

Instead of updating the Controller every six months, applicants now submit Form 3 once within six months of filing, and once again within three months of the First Examination Report.

Relaxed

Form 27 (working statement) filed once every 3 years

Patentees no longer disclose exact revenue/sales figures a simple tick-box confirms whether the patent is commercially "worked," filed once every three financial years instead of annually.

New

Certificate of Inventorship introduced

Inventors can now be formally recognised on record, even where the applicant/owner is a company closing a long-standing gap in Indian patent certificates.

Flexible

Extensions now available on nearly every deadline

Under Rule 138, most deadlines can be extended up to six months on request (Form 4), removing the earlier risk of applications lapsing over a missed non-extendable date.
