Your Brand Identity Has Legal Protection - If You Register It

A Trademark is any mark word, logo, sound, shape, colour, or combination that uniquely identifies your goods or services. Under the Trade Marks Act, 1999, a registered trademark gives you the exclusive, nationwide right to use that mark for your class of business.

Exclusive Legal Ownership

Only you can use the registered mark in your category across all of India. No competitor can legally copy or imitate it.

Use ™ Symbol Immediately

From the moment of filing (not registration), you can legally use the ™ symbol next to your brand signalling trademark protection to the market.

Renewable Every 10 Years

A registered trademark lasts 10 years and can be renewed indefinitely meaning your brand protection never expires as long as you renew.

Monetise Your Brand

A registered trademark is an IP asset. You can license it, franchise it, sell it, or use it as collateral for business loans.

Gateway to Global Protection

Indian trademark registration is the foundation for international protection through Madrid Protocol in 130+ countries.

Legal Action Against Copycats

File infringement cases, seek injunctions, and claim damages against anyone who copies your registered mark with strong legal standing.

What Can You Register as a Trademark in India?

The Trade Marks Act 1999 allows a wide range of marks to be protected. SSATAX expert IP attorneys help you identify the right type for maximum protection.

01

Word Mark

Any word, name, or combination of letters/numbers that identifies your brand. Most common and powerful form of trademark protection.

02

Logo / Device Mark

A visual symbol, icon, graphic, or artistic device used as a brand identifier. Covers your brand logo independent of colour.

03

Composite Mark

A combination of word + logo together as a single mark. Most SMEs and startups register composite marks for full brand coverage.

04

Tagline / Slogan

A phrase or slogan that is distinctive to your brand. Must be unique and not descriptive of the product itself.

05

Sound Mark

Distinctive sounds associated with your brand increasingly popular in India. Must be graphically represented as musical notation.

06

Certification Mark

Used to certify that goods/services meet a specific standard. Granted to an organisation that sets and monitors those standards.

The Real Cost of NOT Registering Your Trademark

Thousands of Indian businesses lose their brand name every year not to theft, but to legal failure. Here's what unregistered brands face.

Brand Hijacking

A competitor can register YOUR brand name as their trademark. Once registered, they can legally send you a cease & desist notice forcing you to rename your entire business.

No Legal Recourse

Without registration, you cannot file an infringement case in court. You can only claim "passing off" which is harder, slower, and far more expensive to prove.

Amazon / Flipkart Brand Lock

E-commerce platforms increasingly require trademark registration for Brand Registry. Without it, copycats sell fake versions of your product under your brand name on your own listing.

Domain & Social Media Disputes

Cybersquatters register your brand as a domain. Social platforms can suspend your account if someone with a registered trademark complains. Registration is your shield.

Rebranding Costs

If forced to rebrand new logo, stationery, website, marketing material, customer communication the cost runs into lakhs. Prevention costs ₹999 with SSATAX. Cure costs much more.

Valuation Impact

Investors, banks, and acquirers see unregistered IP as a red flag. Trademark registration directly increases your brand's valuation and makes due diligence cleaner during funding rounds.

Yes! The ™ symbol can be used as soon as you file your trademark application you don't need to wait for registration. This signals to the market that you are claiming trademark rights over the mark. The ® symbol, however, can only be used after the official Registration Certificate is issued. SSATAX files your application within 24 hours, so you can start using ™ almost immediately.
The full process takes 6-18 months from filing to certificate. However, this should not discourage you from the moment of filing you have rights and can use ™. The timeline breaks down as: Filing to Examination: 1-3 months. Examination to Advertisement: 1-3 months. Journal advertisement period: 4 months. Certificate issuance: 1-2 months after opposition period. If there's an objection or opposition, add 3-12 months. SSATAX actively pushes for expedited examination when eligible.
A trademark objection is raised by the Trademark Examiner if the mark fails on absolute grounds (descriptive, deceptive, offensive) or relative grounds (similar to an already registered mark). An objection does NOT mean rejection it's an opportunity to respond. You must file a Reply to Examination Report within 30 days. SSATAX prepares legal replies citing distinctiveness evidence, coexistence agreements, prior use proof, and relevant case law. We have an 80%+ objection clearance rate. Basic objection reply is included in our standard package.
Trademark Objection is raised by the Examiner during internal examination before the application is published. It's a Registry-initiated process. Trademark Opposition is raised by a third party (typically a competitor or existing brand owner) after the application is published in the Trademark Journal. Anyone can oppose within 4 months of publication. Opposition is more serious it's heard before a Hearing Officer and requires detailed legal submissions. SSATAX handles both objection reply is in our standard package; opposition defence is charged separately based on complexity.
Absolutely and they should register it at the earliest opportunity. Any individual, proprietorship, partnership, LLP, company, trust, or society can apply. For startups and small businesses, SSATAX specifically recommends: (1) Register before launch your filing date is your priority date. (2) Register as MSME/Udyam first to get 50% fee reduction. (3) Register the word mark first, then add logo in a separate application. (4) Consider multi-class if your future expansion plans span multiple categories. Early registration is far cheaper than defending or rebuilding a brand later.
Government fees per class (payable directly to IP India): Individual / Proprietorship / MSME (Udyam-registered): ₹4,500 per class. Company / LLP / Large entities: ₹9,000 per class. SSATAX's professional fee starts at ₹999 (over and above govt. fee). If you have an MSME/Udyam certificate, you save 50% on government fees. SSATAX verifies your eligibility and ensures you get this benefit. We also disclose all fees upfront no surprises.
Yes India follows a "first to file" system for most trademark matters. If a competitor is using your brand name without a registered trademark, your filing will typically take priority. Additionally, if you have been using the mark for a significant period before them, you may have "prior use" rights under common law. SSATAX attorneys analyse both the filing situation and your prior use evidence to build the strongest possible application and stop the infringer's use simultaneously. Time is critical contact us immediately.
Yes. A trademark registered with the Indian Trademark Registry (under the Trade Marks Act, 1999) provides nationwide protection across all states and union territories of India. It does not cover other countries. For international protection, India is a member of the Madrid Protocol you can use your Indian trademark registration as the basis for filing in 130+ countries through a single international application. SSATAX assists with Madrid Protocol filings as a separate service.
If you don't file for renewal before the expiry date, there is a 6-month grace period with a surcharge. After the grace period, the trademark lapses and becomes available for others to register. Once lapsed, your brand has no legal protection. SSATAX sends renewal reminders 12 months, 6 months, and 3 months before expiry as part of our lifetime support. You will never miss a renewal date when you're a SSATAX client.
Yes! The Indian trademark system allows "intent to use" applications. You can register a brand name or logo even before launching your business this is actually strongly recommended. Registering before launch ensures no one else can register the same mark during your launch preparation period, and your protection begins from the filing date. SSATAX files both "already in use" and "proposed to be used" applications the process is identical.
